Terms of Service

These Terms of Service ("Terms") govern your access to and use of Bombyhead, a pageant management platform operated by Bombyhead, LLC ("Bombyhead", "we", "us", or "our"). Bombyhead helps U.S. pageant directors run contests — including registration, payments, photo collection, judging, scoring, tabulation, and People's Choice voting.
By creating an account, accessing, or using Bombyhead in any way, you agree to these Terms. If you do not agree, do not use the service. We refer to the Bombyhead website, applications, and related tools collectively as the "Service".
1. Acceptance of These Terms
These Terms apply to everyone who uses the Service, including pageant directors, contestants, parents and guardians, judges, voters, and anyone who registers an account. Additional policies referenced here — such as our Privacy Policy — are part of these Terms. If you use the Service on behalf of a pageant, organization, or another person, you represent that you are authorized to accept these Terms on their behalf.
2. Eligibility
You must be at least the age of majority in your state of residence to create an account. The Service is intended for pageants operated in the United States. If you are a parent or guardian registering a minor as a contestant, you do so on the minor's behalf and are responsible for that registration and for the minor's participation.
3. Your Account
You agree to provide accurate, current, and complete information when you create an account and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at support@bombyhead.com if you suspect unauthorized use. We may suspend or terminate accounts as described in Section 18.
4. The Service
Bombyhead provides pageant directors with online tools to manage their contests. Core pageant management tools are provided to directors free of charge. Certain features — including payment processing and People's Choice voting — may carry fees or revenue-sharing arrangements, which we will disclose where they apply.
We may add, change, or remove features over time. We provide the Service on an ongoing basis but do not guarantee uninterrupted availability, and we may perform maintenance or updates without prior notice.
The Service is self-service. Any support we provide is optional, offered by email at our discretion, and generally limited to addressing genuine defects in the Service and answering general questions about how it works. We do not provide one-on-one walkthroughs, account setup or configuration on your behalf, phone or live support, or guaranteed response times, and nothing in these Terms or in any guide, email, or other material creates a support obligation or service-level agreement.
5. Payments, Payouts, and Processors
Bombyhead does not itself process card payments. Entry fees, donations, votes, and other payments collected through the Service are handled by third-party payment processors, currently Stripe and Square. Your use of those processors is subject to their own terms and policies.
If you are a director, you are responsible for connecting and maintaining your own payment processor account, for complying with that processor's terms, rules, and regulations as they may change from time to time, and for any taxes, chargebacks, disputes, or refunds associated with payments you collect. Failure to comply with a processor's terms may result in suspension or termination of your access to the Service. For Stripe's terms, see stripe.com/legal; for Square's, see squareup.com/legal.
6. People's Choice
People's Choice voting is an integrated part of the Bombyhead platform. Pageants and events that use Bombyhead's registration services are required to use Bombyhead's People's Choice voting feature for People's Choice or audience-voting awards, and may not use a separate third-party system for that purpose. This ensures a single, consistent experience for participants and voters.
Using an alternative or third-party voting platform in place of Bombyhead's People's Choice feature is a violation of these Terms and may result in adjusted rates, suspension, or termination of your access to the Service.
7. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation, or solicit others to do so;
- infringe the intellectual property or other rights of Bombyhead or any third party;
- harass, abuse, threaten, defame, or discriminate against any person, including on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- submit false, misleading, or fraudulent information;
- upload or transmit viruses, malware, or any code intended to disrupt or damage the Service;
- collect or track other people's personal information, or spam, phish, scrape, or crawl the Service;
- copy, resell, or exploit any part of the Service, or interfere with or circumvent its security features.
We may suspend or terminate access for any violation of this section.
8. Anti-Fraud
Any attempt to defraud Bombyhead is a violation of these Terms. This includes, without limitation, using third-party payment systems such as PayPal or Venmo to collect entry payments off-platform in order to reduce or avoid Bombyhead service fees, or otherwise misrepresenting the number of paid entries.
If we suspect that a pageant is defrauding Bombyhead, we may immediately suspend or terminate that pageant's registration and access to the Service. In addition, the responsible pageant organizer may be billed for each suspected reduced or off-platform entry, not to exceed $100 per contestant, with the invoiced amount due in full within 30 days. Violations of this section may also result in legal action seeking restitution for damages and any applicable penalties under law.
9. Content You Submit
The Service allows directors, contestants, and others to submit content — including contest entries, photos, biographies, answers, and other materials ("Content"). You are solely responsible for the Content you submit and represent that you have the rights to submit it and that it does not violate any law or the rights of any third party.
You grant Bombyhead a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Content as necessary to operate and provide the Service. We may, but are not obligated to, monitor Content and may remove Content we determine, in our sole discretion, to be unlawful, infringing, or otherwise objectionable.
10. Data Ownership and Access
As between Bombyhead and its users, information entered into or collected by the Service — including names, email addresses, phone numbers, and other personal or contact data — is owned by Bombyhead. We may use this data for purposes including operating and improving the Service, communications, and marketing, as described in our Privacy Policy and as permitted by applicable law.
Pageant directors are granted limited, temporary access to data submitted by contestants and participants in their own pageants, solely to manage those pageants. Directors do not own that data, and their access is limited to that operational purpose. Bombyhead may revoke a director's access at any time, including upon the conclusion of a pageant or in the event of misuse. Directors must handle any data they access in compliance with applicable privacy and data protection laws and with these Terms.
11. Finality of Votes and Donations; No Refunds
Votes cast through donations are final. Donations made in connection with voting are irrevocable, and no refunds will be issued for them. By making a donation for votes, you acknowledge and agree that the donation is non-refundable. Refunds for entry fees or other payments, where applicable, are the responsibility of the relevant pageant director and their payment processor, not Bombyhead.
12. Third-Party Services and Links
The Service relies on and may link to third-party services, tools, and websites that we do not control. We provide access to such third-party tools "as is" and "as available" without warranties of any kind, and we are not responsible for the content, accuracy, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to the collection, use, and handling of information as described there.
14. Modifications to the Service
We may modify, suspend, or discontinue the Service, or any part of it, at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
15. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that results obtained from using it will be accurate or reliable.
16. Limitation of Liability
To the maximum extent permitted by law, Bombyhead and its officers, employees, affiliates, agents, contractors, suppliers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of — or inability to use — the Service, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Bombyhead and its parent, affiliates, officers, directors, agents, contractors, licensors, service providers, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms, your Content, or your violation of any law or the rights of a third party.
18. Termination
These Terms remain in effect while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access at any time if we believe you have violated these Terms or to protect the Service or its users. Obligations and liabilities incurred before termination survive termination. You remain liable for all amounts due up to and including the date of termination.
19. Governing Law
These Terms are governed by the laws of the State of [JURISDICTION], without regard to its conflict-of-law principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in that state.
20. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page with its effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
21. Severability and Entire Agreement
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect. These Terms, together with the policies referenced in them, constitute the entire agreement between you and Bombyhead regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision.
